1. Who we are
These terms apply between you and Promi New Face UG (haftungsbeschränkt), Kolkmannskamp 9, 44879 Bochum, Germany ("we"). They cover your use of Atlas at app.brandzey.io. See the imprint.
2. What Atlas is
Atlas is a content dashboard for people who already post. It helps you plan, write, edit, schedule and track content. It uses AI providers and data providers that you connect with your own keys or that we use for you. Output from AI can be wrong. You review everything before it goes out under your name.
We make no promise about views, followers, leads, sales or any other result.
3. Accounts
You sign up with your email and a password. Keep your login private. You are responsible for what happens under your account. You must be at least 18 and act for yourself or for your business.
4. Plans and prices
- Solo: €247 per month or €1,976 per year. One brand.
- Agency: €497 per month or €3,976 per year. Your own brand plus 2 client brands. Each extra brand is €99 per month.
Prices are in euros. Taxes such as VAT are added where the law requires. There is no free trial. Payments go through Mollie. You must pay inside the app before you use it.
5. Renewal, cancellation and refunds
Subscriptions renew automatically at the end of each month or year until you cancel. You can cancel at any time in Settings, then Plan. Access lasts until the end of the period you already paid for. After that the subscription stops and no further payments are taken.
Business customers: we do not give refunds. Onboarding takes our time and starts as soon as you pay.
Consumers: Atlas starts immediately at your express request. At checkout you confirm that your right of withdrawal ends once the service has been fully provided, and that onboarding starts right away. Paid periods are not refunded. This does not limit any right that the law gives you and that cannot be waived.
If a payment fails, we may pause your access after a short grace period until the payment goes through.
6. Agencies and client brands
An agency can create client brands, invite team members and give clients their own login. Clients see only their own brand. The agency is responsible for the content and personal data it puts into client workspaces and for having the right to do so. The data processing terms apply. If an agency subscription ends, access to its client brands ends with it.
7. Your content and your keys
Your content stays yours. You give us the right to store and process it to run Atlas for you. You promise you have the rights to what you upload and connect, and that it does not break the law or anyone's rights.
Atlas works with the API keys you add. Provider costs on those keys are billed to you by the provider. You are responsible for keeping your keys valid and for the terms of those providers and of the social platforms you connect.
8. What you may not do
Do not use Atlas to break the law, to send spam, to harass people, to collect data you have no right to collect, to attack or overload the service, or to resell access except as the Agency plan allows.
9. Availability and changes
We work to keep Atlas running and we ship improvements often. We cannot promise it will always be available or error free. We may change features. If we change a paid plan in a way that hurts you, we tell you in advance.
10. Liability
We are liable without limit for intent, gross negligence, injury to life, body or health, and where the law requires it. For slight negligence we are liable only for breach of a core obligation, and then only for the damage that was typical and foreseeable. Otherwise our liability is excluded. We are not responsible for the output of third-party providers or the actions of social platforms.
11. Ending your account
You can stop using Atlas at any time. We may end an account for a serious breach of these terms, with notice where reasonable. You can ask for your data to be exported or deleted as described in the privacy page.
12. Law and courts
German law applies, excluding the UN sales convention. If you are a consumer in the EU, the mandatory consumer law of your country still applies to you. For business customers the place of jurisdiction is Bochum, Germany.
13. Changes to these terms
We may update these terms. We tell you about material changes before they apply. If you keep using Atlas after that, the new terms apply. You can cancel before then.
